Hi Presley, Thank you for fulfilling my records request relating to the Pas De Chocolat contract with UH. However, I don’t believe that UH has the authority under Hawaii’s open records law to redact the names of subcontractors and related information that was provided by Pas de Chocolat in its bid proposal. I believe it is standard for such information to be disclosed, particularly when it is in response to a RFP. The information does not relate to any proprietary information that could in some way disadvantage the company as it relates to competitors. Further, I don’t believe that 92F-13(1) or 92F-13(3), which you cite, permits such redactions. The names of subcontractors and their professional experience does not constitute an unwarranted invasion of personal privacy. The release of that information also does not frustrate any government function that I can think of. I would appreciate it if you could clarify why UH thinks that this information can be redacted, or provide me with an unredacted copy of the bid proposal. Please let me know if there is a time that we could discuss by phone.
