Aloha Ms. Demoruelle, There is no record of any correspondence between Dora Beck and myself or OEQC starting August 13, 2018. Perhaps you may be thinking there should be some such correspondence because Ms. Beck's secretary (Mary Fujio) indicated in her August 13, 2018 email to me that Dora Beck would be connecting with me. But the next record of correspondence is the provided August 21, 2018 email wherein the directive to rescind the Withdrawal request was provided. There is no record of correspondence between these emails. Thank you, Tom Eisen, Planner Office of Environmental Quality Control State of Hawai’i (808) 586-4185 NOTE: OEQC’s primary role is to facilitate Hawai’i’s environmental review process by providing relevant advice to agencies, applicants, consultants and the public. OEQC is not authorized to make determinations on Environmental Assessments, Environmental Impact Statements or exemptions. Pursuant to Chapter 343, Hawai’i Revised Statutes, all such determinations are made by appropriate State or county agencies, county Mayors or the Governor.

Dear Sir or Madam, I was told by Dep. Corp. Counsel that the COHDEM had been told by OEQC that they did not have to withdraw the original FEA. However, the UIPA correspondence does not seem to give any substantive guidance as he had referred to. That is why I keep asking as it seems something is missing. Sincerely yours Sandra Demoruelle

Dear Ms. Demoruelle, Thank you for your follow up question. We have sent you all records that we have pursuant to your request. We are not aware of any communications you and the County of Hawaiʻi might have had or how the County might choose to represent to you any communications they might have had with us. The EIS statute, Chapter 343, places sole responsibility and authority for decision making with the agency and does not allow the OEQC to be a decision maker. As such, the OEQC only offers advice and recommendations to agencies as they consider their own courses of action. The decision to withdraw an environmental assessment or finding of no significant impact is the agency's decision to make, similarly to the agency's decision to rescind a withdrawal request. Respectfully, Tom Eisen, Planner Office of Environmental Quality Control State of Hawai’i (808) 586-4185 NOTE: OEQC’s primary role is to facilitate Hawai’i’s environmental review process by providing relevant advice to agencies, applicants, consultants and the public.
