Perhaps you may be thinking there should be some such correspondence because Ms. Beck's secretary (Mary Fujio) indicated in her August 13, 2018 email to me that Dora Beck would be connecting with me. But the next record of correspondence is the provided August 21, 2018 email wherein the directive to rescind the Withdrawal request was provided. Dear Ms. Demoruelle, Thank you for your follow up question. We have sent you all records that we have pursuant to your request. We are not aware of any communications you and the County of Hawaiʻi might have had or how the County might choose to represent to you any communications they might have had with us. The EIS statute, Chapter 343, places sole responsibility and authority for decision making with the agency and does not allow the OEQC to be a decision maker. As such, the OEQC only offers advice and recommendations to agencies as they consider their own courses of action. The decision to withdraw an environmental assessment or finding of no significant impact is the agency's decision to make, similarly to the agency's decision to rescind a withdrawal request.
