December 3, 2021 Records Access Officer Hawaii State Elections Office Re: Uniform Information Practices Act (UIPA) Request Elections Office Communications re: General Election from the dates 11/02/2020 through 11/04/2020 Aloha Records Access Officer: Pursuant to the Hawaii Uniform Information Practices Act (“UIPA”), Hawaii Revised Statutes Chapter 92F, I hereby request the following records be produced in the common electronic format as described below: 1. From the dates of 11/02/2020 through 11/04/2020, all communications pertaining to the 2020 General Election in Hawaii between the Chief Elections Officer Scott Nago and Elections office staff members, including but not limited to: regular mail, emails, phone logs, inter-office memos, Microsoft Teams and/or Google Drive, and shared calendars with attachments. i. The following formats are acceptable: .csv, .xls, .xlsx ii. For records that only exist on paper, Adobe PDF scans will be sufficient iii. For records that exist only in electronic format, exact copies are requested to extent they are not in proprietary formats. iv. For records that exist only in electronic format, but contain sensitive information explicitly exempt from disclosure (such as a SSN), exact copies are requested to extent they are not in proprietary formats, etc., with only the protected information (but not blank or null data) overwritten with some notation of the statutory exemption. If no records exist responsive to the above request(s), I hereby request a certification to that effect. For records produced in response to the request(s), I hereby request certifications that the record(s) produced are correct. I am requesting that these records be produced in electronic format and sent to the email address above. If records are too voluminous to be sent via email please contact me to discuss alternatives. If there is expected to be a delay in providing a part of the requested records, kindly produce the certified copies that are available and provide the remainder on a “rolling basis”. If my request does not adequately describe the records to be produced, please contact me via e-mail so that I may clarify my request, and when appropriate inform me of the manner in which records are filed, retrieved or generated. Pursuant to the UIPA, records available for public access in their entireties must be disclosed within a reasonable time, not to exceed 10 business days from the date the request was received, or after receipt of any prepayment required. In order to distinguish this request from other requests, you identified it as "#594." It stated, in part, the following: Pursuant to the Hawaii Uniform Information Practices Act ("UIPA"), Hawaii Revised Statutes Chapter 92F, I hereby request the following records be produced in the common electronic format as described below: 1. From the dates of 11/02/2020 through 11/04/2020, all communications pertaining to the 2020 General Election in Hawaii between the Chief Elections Officer Scott Nago and Elections office staff members, including but not limited to: regular mail, emails, phone logs, inter-office memos, Microsoft Teams and/or Google Drive, and shared calendars with attachments. i. The following formats are acceptable: .csv, .xls, .xlsx ii. For records that only exist on paper, Adobe PDF scans will be sufficient iii. For records that exist only in electronic format, exact copies are requested to extent they are not in proprietary formats. iv. A "Notice to Requester" was submitted to you on December 17, 2021. The notice indicated that your request would be granted in part and denied in part and indicated the estimated fees and costs. On January 7, 2022, our office received your personal check for half of those fees and costs. With the above in mind, we proceeded to process your records request. The records, which will be sent in two subsequent emails, reflect the records that were deemed responsive and that did not contain information that could be withheld under one of the UIPA's exceptions to disclosure. Before determining which records could be withheld, we determined whether a record was reasonably segregable or not. To the extent that it was not possible for technical reasons, in the context of emails, to separate information to be redacted from the remainder of a record, then the record was deemed not reasonably segregable and the record was withheld. As previously noted, the records that were withheld fell under one of the UIPA's exceptions to disclosure. Specifically, the records fell into the following groups. 1. Unwarranted Invasion of Personal Privacy - HRS § 92F-13(1) Records were withheld that contained personal email addresses or other information that would have undermined the personal privacy of individuals. These types of records are covered by HRS § 92F-13(1). 2. Communications with Legal Counsel - HRS §§ 92F-13(2)-(4) Records were withheld that involved communications with legal counsel. These types of records are covered by HRS §§ 92F-13(2)-(4). 3. Frustration of a Legitimate Government Function - HRS § 92F-13(3) Records were withheld that would frustrate a legitimate government function by their disclosure. Specifically, records that relate to complaints that may be investigated by government officials were not disclosed, as the disclosure of such records would undermine the ability of government to receive complaints and to investigate them. Additionally, records relating to cybersecurity were not disclosed, as the disclosure of such records would undermine the ability to maintain the security of our systems. Finally, records relating to communications with law enforcement and security officials were not disclosed, as the disclosure of such records would undermine law enforcement and security operations. These types of records are covered by HRS § 92F-13(3). As it relates to payment, we have not deposited your check at this time and will revisit how much in fees and costs will be assessed following the closing of this records request.
