Attached is a copy of the public certified record on appeal. OIP is withholding the sealed portion of the record on appeal, consisting of the records originally provided for OIP's in camera review, based on the UIPA's frustration exception, section 92F-13(3), HRS, as disclosure would frustrate OIP's ability to perform its function of reviewing disputes regarding records withheld by an agency. Please be advised that OIP's attorney was served yesterday with an unfiled copy of a motion to seal part of the public certified record on appeal. As that motion has not yet been heard, nor have we received a filed copy, OIP has no basis at this time to withhold any part of the public certified record on appeal, but should the motion be granted then a portion of the record may be sealed in the future.
