Aloha, Attorney/client priviledge is an invalid reason for failing to respond to my request.. I did not ask for personally identifiable or case specific information. I asked for aggregate numbers of the number of cases referred to the O'ahu office, and the number of cases that went to trial. Your office also sent me the budget for the entire Office of Public Defender, and it contains no information that is discernible about costs and payroll for their O'ahu office. Dear Mr. DeGiacomo, We do not keep records on the number of cases which proceeded to trial. Also, your request included a laundry list of information pertaining to trials done which would fall under the attorney client privilege. Our budget is not allocated per island. Our office is statewide and we receive a lump sum allocation from the legislature. We don't separate out expenses by island. Thank you, John M. Tonaki Public Defender

Aloha! Mahalo for your reply. So your office provides no imput into the amount asked for statewide? Nor are there any financial records of what is spent? And your internal calendar contains no record of days you were in trial - which would be a matter of public record as all trials are available through the judiciary database? What is the O'ahu office budget, general categories for the budget, the number of attorneys, the number of support staff, and salary range for attorneys and support staff? Surely, someone can look at your internal phone directory to answer my staffing question, and you must have job postings for these positions listing the salary range. ...
