Hi Bin, Thanks for the April info, but it excluded the State total. Since Bruce Anderson provided this to media in March, we know it's ok to be release and expect you to release it to us. Can you please update the data to include the the total for the state. For the sake of saving time, I'm fine for May and June totals for the state right now. And receive the breakdowns later this month. Also would like to know how many sea cucumbers have been reported since November 2017. Mahalo, Rene Umberger

Hi Rene, The reason was simply because of one fisherman reporting harvests of opae ula in those months that skew the data. The statewide numbers lump all of the figures together and my cause some confusion understandably. Bin C. Li Administrative Proceedings Coordinator Department of Land & Natural Resources 1151 Punchbowl Street, Room 130 Honolulu, Hawaii 96813 Tel 808-587-1496, Fax 808-587-0390 <<email address>> _____________________________________ My understanding of the the ‘hand net’ method of collecting is that hand nets are used exclusively (i.e. without a barrier net). The definition of a hand net is contained in HAR §13-75-1. The legal authority for aquarium collectors to use fine mesh hand nets (mesh smaller than 2” stretched) is contained in HAR §13-75-14 and HRS §188-31. HAR CHAPTER 13-75 RULES REGULATING THE POSSESSION AND USE OF CERTAIN FISHING GEAR §13-75-1 Definitions. As used in this chapter, unless otherwise provided: “Hand net” means a net consisting of a bag of mesh material attached to a frame to hold the bag open, and a handle. The net is small enough to use with one hand by one person. §13-75-14 Nets, generally. It is unlawful for any person to use nets made of or using netting with a stretched mesh of less than two inches, except that: (4) Aquarium fish collectors with a valid aquarium fish permit issued pursuant to section 188-31, HRS, may use traps and nets for aquarium fish and other aquatic life in conformance with the conditions of the permit, provided that non-commercial aquarium fish collectors shall be limited to a combined total of five fish or aquatic life specimens per person per day; HRS §188-31 Permits to take aquatic life for aquarium purposes. (a) Except as prohibited by law, the department, upon receipt of a written application, may issue an aquarium fish permit, not longer than one year in duration, to use fine meshed traps, or fine meshed nets other than throw nets, for the taking of marine or freshwater nongame fish and other aquatic life for aquarium purposes. Hi Bin, Thanks again to you, Reg and DAR for providing this thorough information. I have a few questions and will send them, item by item. This first one is regarding item 3, invertebrate catch for 2018. In an earlier request, you provided sea cucumber reported catch from 11/2017 to 6/2018, but there are no sea cucumbers reported in this most recent data. Dear Bin, I do have a question regarding item 5. I appreciate the explanation for the use of hand nets, however I'm not sure it is valid, given that according to HAR 13-75-14 (7) use of hand nets or scoop nets of smaller mesh to take fish or other marine life is allowed for noncommercial purposes only. This is very clear. A number of exceptions are spelled out elsewhere in the section, however, none exist for commercial use of small mesh hand nets. It also raises the question about current use of hand nets. Is DLNR enforcing this rule, or are the commercial collectors being allowed to use small mesh hand nets to capture fish? We have evidence and a firsthand account of approx. a dozen Hawaii snowflake morays present at an Oahu wholesaler earlier this year. Hi Rene, This is to confirm that the Snowflake eels were included in the 'alll other' category for the 2018 aquarium fish catch and dealer report summaries. This is because the number of licensed reporters were less than 3 and were pooled with other finfish species for the same reporting reason. The Snowflake moray eel is not a regulated species. The harvesters had CMLs. None were caught in WHI, and harvesting is permissive on Oahu. Bin C. Aloha Rene, Here's DAR's answer to your question below: Commercial collectors are not allowed to use fine-meshed hand nets to collect aquarium fish. However, outside of West Hawaii, aquarium collectors are allowed to use hand nets with 2" mesh or greater to take aquarium fish for commercial purposes. (Within West Hawaii, all commercial and recreational aquarium collection is prohibited, regardless of gear.) The commercial marine license reports don’t distinguish between fine-meshed and legal mesh hand nets. DLNR is enforcing this rule. Anyone using fine meshed hand nets for commercial purposes is in violation of the law. Bin C. I appreciate the explanation for the use of hand nets, however I'm not sure it is valid, given that according to HAR 13-75-14 (7) use of hand nets or scoop nets of smaller mesh to take fish or other marine life is allowed for noncommercial purposes only. This is very clear. A number of exceptions are spelled out elsewhere in the section, however, none exist for commercial use of small mesh hand nets. It also raises the question about current use of hand nets. Is DLNR enforcing this rule, or are the commercial collectors being allowed to use small mesh hand nets to capture fish? Hi Rene, We found that there were certain aquarium fishermen who reported collection of sea cucumbers for the first six months in 2018. No collection has been reported since July 2018. Yes, Bin, it is helpful only in that it confirms what we suspected -- that DLNR is too underfunded / understaffed to enforce its own rules. We surely hope the legislature remedies this very soon for you! Has DLNR notified CML holders with AQ reporting that sea cucumber take is illegal? Hi Rene, I do agree with you DLNR needs more supports. In regard to the sea cucumber take question, yes. On August 20, 2018, DAR sent the following email message to Oahu aquarium collectors: Dear Oahu Commercial Aquarium Collector, Please be advised, the harvesting of sea cucumber for commercial aquarium purposes under Hawaii Administrative Rules §13-86 on Sea Cucumber Management is prohibited.
