Dear Fire Records Section:
Thank you for sending a response to the request for records in the above-identified matter.
According to the transmittal that accompanied the response from the Hawaii Fire Department (FIRE-H), it states that you are "releasing the government record based on the authority found in HRS §92F-19(a). Please note HRS §92F-19(b), that the agency receiving government records pursuant to §92F-19(a) is also subject to the same restrictions on disclosure of the records as the originating agency."
The Office of Information Practices (OIP) opened this request for assistance file due to FIRE-H's failure to respond to a government record request submitted by an individual, Ms. Devi Chung. At the present time, this is not an appeal.
Under the UIPA and its administrative rules, agencies should provide its response to a record request directly to the requester, not OIP.
If FIRE-H intends to deny access to this request, the written denial stating the basis for the denial under the UIPA should be sent to Ms. Chung. That way, if FIRE-H denies the request, Ms. Chung can file an appeal with OIP. If FIRE-H's intent was to disclose the attached Log to Ms. Chung, FIRE-H should provide that record directly to her, and send OIP a copy of the transmittal so that OIP is aware of FIRE-H's response to her.
