Your public records request has been referred to me for review, research and a reply.
Our records indicate that the Department of Planning and Permitting has provided you with copies of the complete files of 31 approved shoreline setback variance permits that were issued between 2000-2020, (with the exception of 2 from 2019 which had not yet been approved), when you made a similar request in January, 2020. They were either in hard copy or on a USB drive. The Decision and Orders were included in the complete files.
Ordinance 18-3, Section 3, Section 6-11.4 of the Revised Ordinances of Honolulu 1990, states that newspapers "may be exempted from the payment of fees established in this article...provided that the exemption from the payment of fees or charges, or both, is limited to one copy or one set of such records or publications."
If you want us to provide you with another copy of the Decision and Orders, there will be a charge of a $5.00 processing fee PER file, plus copy charges of .50 for the first page and .25 for each additional page. These charges will also apply if the documents are emailed, as we will have to print then scan the copies. For copies from the two 2019 files, there will be no charge.

On January 4, 2021, I sent you an email stating that if you wanted copies of documents that were already provided to you that there would be a charge. Copies of documents which had not been previously provided to you would be at no charge.
Under the Hawaii Administrative rules, Section 2-71-16, you have 20 business days to respond. The 20 day period expired on February 2, 2020.
Since we did not receive a response from you, this job is considered closed. If you wish to obtain copies in the future, you will need to submit a new request.
