Having said that, there are limits to what we can produce, especially when asked for information that is not covered by the Uniform Information Practices Act (UIPA) and providing the information would a require substantial commitment of time and expense by the Judiciary. Hawaii Revised Statues §92F-3 states that the Uniform Information Practices Act "does not include the non-administrative functions of the courts of this State” (i.e., court records). Also, HRS 92F-11 (c) says, “Unless the information is readily retrievable by the agency in the form in which it is requested, an agency shall not be required to prepare a compilation or summary of its records.” You have asked for “all adult criminal case dispositions” since 2008. These are court records that are not covered by the Uniform Information Practices Act and are not readily retrievable. We believe there are more than one million adult cases since 2008. We estimate it would take days to retrieve, sort, and compile this information. The cost of this search would be at least $10,000, and if the search were done, the cost would be passed along to you. Also, we may not be able to provide everything you seek. Please let us know if you would like to limit the scope of your inquiry. We may be able to accommodate a limited search; however, you may still incur cost. Aloha Ms. Clasen, Sorry for the delay, and thank you so much for your thoughtful response and for the Judiciary’s continued commitment to open government. I truly appreciate the time and care you’ve taken to explain the limitations under HRS §92F and the distinction regarding non-administrative court records. I’d like to follow up with a sincere and respectful clarification. While I understand that the Judiciary is not be required to compile case-level data under UIPA, I believe the specific records I’m requesting—basic fields such as case number, charge, disposition, and sentencing outcome—are likely stored in a structured format (usually CSV or XLS) within the JIMS system or another internal database. If that’s the case, the process of generating an export (e.g., filtered by date range) may be quite straightforward—akin to running a predefined report or selecting fields and generating a CSV or Excel file. My hope is not to request anything burdensome or time-intensive, but simply to receive data that’s already maintained in the normal course of operations, and that could be shared in its existing form. I completely understand if there are limitations or vendor-related constraints on how such data is accessed or shared. But if there’s any possibility that this data is already being compiled for internal use, inter-agency coordination, or public dashboards, I’d be grateful to receive whatever format is most readily retrievable. My goal in requesting this information remains to support community understanding and policy development around justice system outcomes. If there’s a way to provide even a limited extract—perhaps for a more recent timeframe, or a more basic set of fields—I’d be very happy to adjust accordingly. On a related note, we are building an app for the agencies and entities involved in the criminal justice system (HPD, the Judiciary, the Prosecutor's Office, the Public Defenders, the Department of Public Safety, etc.) as a universal case management system where the public can report non-violent crimes online, and the governmental agencies can manage, update, and track cases all on one site.
