Pursuant to the public records law, I would like to request the following records in electronic format sent to my email address.
I am requesting the following records concerning the Department of Facility Maintenance's enforcement of stream and drainageway maintenance responsibility against private property owners on Oʻahu.
Time period: January 1, 2015 through the date of this request.
Records requested:
1. All final orders issued by DFM to private property owners under HRS §46-11.5 and/or Revised Ordinances of Honolulu §40-2.3 (formerly §41-26.3) requiring maintenance of channels, streambeds, streambanks, or drainageways.
2. All records of civil penalties assessed against private parties under the $500-per-day penalty provision of HRS §46-11.5, including the amount assessed, date of assessment, and final disposition.
3. All records of instances in which DFM performed maintenance work at City expense and imposed a lien on the private property, including the property address, the cost of work performed, and the status of the lien.
4. Any internal DFM policy, directive, standard operating procedure, or guidance document governing when and how the Department issues orders, assesses penalties, or performs lien-backed maintenance work under HRS §46-11.5 or ROH §40-2.3.
