I am a reporter for Maui Times. For the following reasons, I believe that waiver of search, review, and
segregation fees for my request for government records would serve the public interest. The requested records concern the operation and activities of the Mayor of Maui County. The records reflect the scope and nature of the Mayor's policies, decisions, or orders/management; and oversight of county resources. The requested records are not readily available in the public domain. I have searched Maui County's website and could not find the requested records. If the records are readily available, please let me know where to find them. I intend and have the ability to widely disseminate information in the requested government records to the general public.

Please see the email chain below that includes the legal opinion from an OIP attorney that refers to OIP opinion 4-17. https://oip.hawaii.gov/formal-opinion...
Based on the advice from OIP in the email below and the guidance in OIP opinion 4-17, I do not believe the records you requested are government records. So, there would be no responsive records to the requests. To quote OIP, "Based upon the totality of these representations, the OIP found the Calendars and the telephone message slips generally to be personal records of the City Officials and not “government records” subject to disclosure under the UIPA."

Dear Mr. Forrest:
OIP Opinion Letter 04-17 relates to the issue of calendars and schedules. Please note that scheduling communications are not as a class “not subject to open records requests”, but rather they are sometimes not considered “government records” if they are created solely for an individual employee’s personal convenience and not circulated or intended for distribution for official purposes. In such cases, they would be considered to be held by that employee in his personal capacity and would not be considered government records “maintained” by the agency.

I will clarify my request: Pursuant to the public records law, I request the following records in electronic format sent to my email address.
A copy of each council member’s daily schedule and officer calendar. Calendar records should include all events, meetings, and conversations in which the council member is operating in their official role as an elected government official.
I am not requesting personal records of council members that they created or ordered the creation of by an assistant, and then used or plan to use in their personal capacity as a citizen. Any documents that contain personal appointments, such as medical visits, children’s birthdays, and so forth, may contain redactions of these personal appointments.
Please limit this request to any documents generated between Jan. 3, 2021 and the date on which this request is processed. Please provide the calendar data in spreadsheet form (.xlsx or .csv), or, if that doesn't work, in a document (searchable, not .pdf).
By revising this request, I withdraw my other previous requests seeking records of council members’ calendars. If you deny the public interest fee waiver request, and in the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.
